5 Things You Should Know Regarding Child Support

Whether you are new to child support or have been paying it for some time, it is essential to know what it is and how it can be managed with you and your former spouse.

For a brief overview, child support is money paid to cover few or all of your child’s basic needs. For example, food, clothing, housing, education, and childcare. In some situations, health and medical coverage may be included.

Our team at the Law Offices of Joshua Adam Kittenplan located in Commack, New York, understand that it is common to face challenges when it comes to paying child support, which is why we are here to assist you.

A few things you should know:

  1. According to Ebony Magazine, the average child support payment made in the U.S. is $430 a month.

  2. Child support money is completely tax-free income for the recipient, but is not tax-deductible for the person paying child support.

  3. Child support orders can always be modified by a court order. (If there has been a significant “change of circumstances,” either parent can go back to court and request that child support be increased, decreased, or even eliminated).

  4. Unemployed due to COVID-19? A parent who is unemployed or has a reduction in income is still required to pay all court-ordered child support. Yet, there is an exception which is if that parent has received a court-approved, written child support modification from a judge.

  5. Failure to pay child support can lead to serious consequences, including wage garnishment, asset seizure, credit bureau reporting, driver’s license suspension, passport denial, withholding of unemployment benefits, and even arrest or jail time.
